Casio Computer Co., Ltd. ("CASIO") provides a user who agrees to these Terms ("User") a service that allows User to convert Continuous Shutter (CS) images shot with by a CASIO digital still camera equipped with Dynamic Photo to a movie ("Service").
The movie created by this Service ("Movie") will be stored in servers controlled by CASIO for thirty (30) days from its creation. However, CASIO does not guarantee such storage will be complete and unfailing.
Movies and original images uploaded using this Service are stored at User's own risk.
User hereby grants CASIO a worldwide, perpetual, royalty-free, irrevocable, nonexclusive license (with a right to sublicense) to use, reproduce, modify, adapt, publish, transmit and distribute any Movie in any form or medium. In addition, User warrants that User has waived all so-called moral rights to Movies.
All rights, title, and interest in and to this Service, including, but not limited to, copyrights, patent, or trademarks, are owned by CASIO or CASIO’s licensors.
User agrees not to reproduce, alter, modify, or publicly display, in whole or in part, this Service without CASIO's prior written approval.
User agrees not to post on or through this Service any Movie that:
(a) is defamatory; (b) is harassing or invades others’ privacy; (c) promotes bigotry, racism, hatred or harm against any group or individual; (d) is obscene; (e) infringes others’ rights, including but not limited to intellectual property rights; or (f) violates any applicable laws or regulations. CASIO reserves the right to remove any Movie that, at CASIO's sole discretion, falls into any of the foregoing (a) through (f).
CASIO may change, modify, suspend, or discontinue this Service at any time without any notice to User.
THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR GUARANTEES WHATSOEVER. CASIO EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, GUARANTEES, OR REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY AND INTELLECTUAL PROPERTY RIGHTS. CASIO MAKES NO WARRANTY OR GUARANTEE THAT THIS SERVICE WILL BE UNINTERRUPTED, USEFUL, COMPLETE, ACCURACY, SECURE, OR ERROR-FREE. USER UNDERSTANDS AND AGREES THAT USER USES THIS SERVICE AT USER’S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES THAT MAY RESULT, INCLUDING LOSS OF DATA OR DAMAGE TO USER'S COMPUTER SYSTEM. IN NO EVENT SHALL CASIO BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY TYPE WHATSOEVER RELATED TO OR ARISING FROM ANY USE OF, OR INABILITY TO USE, THIS SERVICE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA, EVEN IF CASIO IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS EXCLUSION AND WAIVER OF LIABILITY APPLIES TO ALL CAUSES OF ACTION, WHETHER BASED ON CONTRACT, WARRANTY, TORT, OR ANY OTHER LEGAL THEORIES.
CASIO reserves the right to revise these Terms from time to time without notice by updating this posting. By using this Service, User agrees to be bound by the then current version of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court of Japan shall have exclusive jurisdiction over any dispute that may arise in connection with these Terms and this Service.
